Abstract This paper (1) will indicate why, under existing civil law, generators of hazardous wastes are relatively immune from liability for personal injuries caused by releases of toxic substances from on-site and off-site land disposal sites; (2) will suggest the changes in existing civil law that will probably occur in the near future, to facilitate imposing legal liability for personal injuries on generators of hazardous wastes; and, (3) will suggest techniques for minimizing the combined future costs of hazardous waste disposal and the payment of damage awards for personal injuries.
